World Health Organization- Consent for Vaccination & Liability

Laws pertaining to children’s consent to vaccination defaults to and varies by state. However if a minor was vaccinated without parental consent, due to the EUA and PREP Act the vaccinator would be protected from legal liability.
According to the WHO, in certain countries around the world parents may be considered to have provided an ‘implied consent’ in a manner by allowing their children to attend school on a day known for vaccinations administration. Ideally the parents would be previously informed about the vaccination schedule at the school or similar facility and given the opportunity to opt-out of the vaccination if they don’t consent.
